DC Comics © November 1964, Action Comics #318. The story is "The Death of Luthor!".   Luthor escapes from prison and flees to the planet Lexor, where he is considered  a hero. Superman pursues him, but accidentally kills Luthor in a fight. Superman is arrested and must stand trial for murder.
